Waiver and Release of Liability for Grit Programming

1. Introduction

This document serves as a Waiver and Release of Liability for participants in the Grit Programming online competitive functional fitness program (the "Program"). By agreeing to this document, you, the participant, acknowledge understanding the risks associated with participation and agree to the terms herein.

2. Assumption of Risk

You acknowledge that participation in the Program involves physical exertion and inherent risks associated with functional fitness activities. You voluntarily assume all risks, known and unknown, associated with your participation in the Program, including but not limited to injury, illness, or property damage.

3. Release of Liability

You hereby release, waive, discharge, and covenant not to sue Grit Programming, its affiliates, officers, agents, employees, and other participants (collectively, "Releasees") from any and all liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever arising out of or in any way connected with your participation in the Program, whether arising from the negligence of the Releasees or otherwise.

4. Privacy and Personal Information

a. Collection and Use of Personal Information: In order to participate in the Program, you agree to provide necessary personal information such as your name, email address, age, and fitness level. This information will be used solely for the purpose of administering your participation in the Program, including but not limited to registration, communication, and program personalisation.

b. Email Marketing Consent: By providing your email address, you consent to receive promotional emails from Grit Programming regarding products, services, and promotions related to functional fitness, as well as updates and newsletters about the Program. You acknowledge that you can unsubscribe from these communications at any time by following the instructions provided in the emails.

c. Privacy Rights: In accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have certain rights regarding the handling of your personal information, including the right to access, correct, and lodge a complaint regarding the handling of your personal information.

d. Security of Personal Information: We are committed to protecting the security of your personal information and will take reasonable steps to prevent unauthorised access, use, or disclosure.

5. Governing Law

This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of Australia, without giving effect to any principles of conflicts of law.

6. Acknowledgment

By participating in the Grit Programming, you acknowledge that you have read this document, understand its terms, and agree voluntarily as a condition of your participation in the Program. You acknowledge that this agreement is intended to be as broad and inclusive as permitted by the laws of Australia and agree that if any portion is held invalid, the remainder will continue in full legal force and effect.
